Terms of use

Updated: 18 October 2026 · This is an English translation. If the Hebrew and English versions differ, the Hebrew version prevails.

This document has two parts. Part A applies to everyone who visits e26.ai. Part B is the terms of use of the E26 service itself, and applies to anyone who opens an account or buys a subscription.

Part A: Using the website

1. Who we are. The website e26.ai (the "Website") is operated by E3E Technologies, licensed dealer no. 209080407, of 16 Homa uMigdal St., Tel Aviv ("we"). The Website presents E26, an operating system for businesses (formerly called E3E). Browsing the Website means you accept the terms in this part.

2. Information on the Website. The information on the Website is general and meant to introduce the service. It is not a binding offer. Use of the service is governed by the terms in Part B and by the plan actually purchased.

3. Screens and demos. The screens, videos and demos on the Website are illustrations only. The names, phone numbers, amounts and conversations in them are fictitious and are not data of real customers. The actual system may differ from the illustrations, and it is updated from time to time.

4. Prices. Prices on the Website are in Israeli shekels, exclude VAT, and are intended for businesses. The binding price and exact terms of each plan, including yearly payment, are those shown on the checkout page at the time of the order.

5. Logos and trademarks. The Website shows logos of businesses that work with us and of technology companies whose technology the service runs on or connects to. These logos and trademarks belong to their owners. Showing them does not imply any partnership, sponsorship, funding or endorsement by those companies.

6. Intellectual property. The content, text, design, videos and code on the Website belong to us or are used under licence. They may not be copied, distributed or used commercially without our prior written permission.

7. The blog. Blog articles are general information, not legal, accounting, professional or other advice. Do not rely on them instead of suitable advice.

8. Contacting us through the Website. The contact buttons on the Website open a WhatsApp chat or a calendar for booking a meeting. Details you share there are handled under our Privacy policy.

9. External links. The Website links to external services such as WhatsApp, Google Calendar and our app. We are not responsible for the content or policies of sites we do not control.

10. Liability. The Website is provided as is. We do not promise it will run without faults or interruptions. To the extent the law allows, we are not liable for damage caused by using the Website or relying on its information.

11. Accessibility. We work to make the Website accessible. Details are in the Accessibility statement.

12. Law and jurisdiction. Use of the Website is governed solely by the laws of the State of Israel, and the courts of Tel Aviv have exclusive jurisdiction.

13. Changes. We may update this part from time to time. The binding version is the one published on the Website at the time of browsing.

Part B: Terms of use of the E26 service

Version 1.1 · Updated: 3.9.2026

1. General

1.1. These terms govern the use of the E3E platform (the "Service"), operated by E3E Technologies, licensed dealer no. 209080407, of 16 Homa uMigdal St., Tel Aviv (the "Provider", "we").

1.2. The Service is intended for businesses only. It is not intended for private use or for minors.

1.3. Opening an account, ticking the consent box, or using the Service constitutes full acceptance of these terms and of the Privacy policy, which forms an integral part of them.

1.4. The binding document is the version you approved at the time of purchase. We keep a record of the time of consent, IP address, document version and the plan purchased.

2. Definitions

Term Meaning
Customer The business that bought a subscription
User Anyone the Customer allowed to use the account
End customer Anyone the Customer communicates with through the Service
Customer content Any data entered by the Customer or its end customers, or received through the Service
AI agent An automated component that analyses information and drafts and sends communications
Third-party providers Meta · Google · Supabase · language and voice model providers · Morning/Grow · GreenAPI

3. The Service

3.1. We grant the Customer a personal, limited, non-exclusive and non-transferable licence to use the Service for the subscription period only.

3.2. The scope of the Service is determined by the plan purchased. Features not included in the plan are not part of the Service.

3.3. We may change, add or remove features. Material removal of a core feature will be notified 30 days in advance, and the Customer may cancel and receive a pro-rata refund.

3.4. Demo period: a demo account is provided free of charge for a limited time, with no commitment to availability, data retention or continuity. At the end of the period access is blocked until a plan is purchased.

4. AI agents: the central section

4.1. The Service includes automated agents based on third-party artificial intelligence models, which draft and send communications on behalf of the Customer and under its responsibility.

4.2. AI technology is probabilistic, not deterministic. It may produce content that is wrong, inaccurate, outdated, unsuitable or unexpected, even when configured correctly. The Customer declares that it understands this, and that it is an inherent property of the technology and not a fault.

4.3. Agent output is not advice: not legal, medical, financial, tax or professional advice of any kind, and must not be relied on as such.

4.4. The Customer is the sender. Every message an agent sends is deemed sent by the Customer, on its behalf and under its full responsibility, including towards its end customers and any authority.

4.5. Duty to supervise. The Customer undertakes to:

  • configure the agent and its knowledge base accurately and keep them up to date
  • review the agent's activity on an ongoing basis
  • pass to human handling any sensitive or binding matter, or any matter with financial or legal implications
  • not rely on the agent to make binding commitments to end customers

4.6. Limits on commitments. A quote, date, payment term or any commitment made in a conversation with an agent never binds the Provider, and binds the Customer only subject to the law applying between it and its end customer.

4.7. The Customer waives any claim against the Provider for content an agent produced, sent or failed to send, and for any direct or indirect damage resulting from it, subject to section 4.10.

4.8. Recording and transcription. Voice calls are recorded and transcribed. The duty to inform the end customer and obtain consent lies solely with the Customer, including under the Wiretap Law and the Privacy Protection Law.

4.9. Resource use. Using agents involves variable costs. Exceeding the limits of the plan entitles us to restrict, suspend or charge extra, after notice.

4.10. Nothing in this section exempts the Provider from liability for damage caused wilfully or by gross negligence, or from liability that cannot be excluded under mandatory law.

5. Customer obligations

5.1. The Customer undertakes that every contact list it uploaded was collected lawfully, and that it holds the consents required under the Communications (Telecommunications and Broadcasting) Law, Amendment 40 (the "Spam Law").

5.2. WhatsApp. Use is subject to Meta's policies. The Customer is responsible for obtaining opt-in from end customers, for message quality, and for any block or suspension of a number by Meta. A block by Meta is not a fault in the Service and does not entitle the Customer to a refund.

5.3. Prohibited: unlawful, misleading, infringing or offensive content; attempts to bypass plan limits; reverse engineering; reselling the Service without written approval; deliberate overloading.

5.4. Account security. The Customer is responsible for keeping its login details confidential and for actions taken in its account, including by its employees. It must report any suspected misuse immediately.

5.5. Permissions. The Customer decides which users see what. We provide the tool; configuring it correctly is the Customer's responsibility.

6. Payment

6.1. The price is per plan, plus VAT, by recurring monthly direct debit.

6.2. The first charge is made at the time of purchase, and later charges on the same day each month. The subscription renews automatically until cancelled.

6.3. Cancel at any time, with no commitment period. Cancellation takes effect at the end of the current billing cycle. There is no refund for part of a cycle already used. The Customer declares that it purchases the Service for its business and not as a consumer, and therefore the Consumer Protection Law, 5741-1981, does not apply to this engagement.

6.4. Non-payment entitles us to suspend access after 7 days and notice. Data is kept during the suspension.

6.5. A price change applies from the next billing cycle only, with 30 days' notice.

6.6. An upgrade takes effect immediately. The existing charge remains, and a direct debit for the difference only between the current and new plan is added, so that the total monthly charge equals the new plan's price. There is no pro-rata credit for the remainder of a cycle already paid.

6.7. Moving to a lower plan is done by contacting us and takes effect from the next billing cycle. There is no refund for part of a cycle already used.

6.8. Payment is processed by an external provider. We do not store payment details.

7. Data and intellectual property

7.1. Customer content belongs to the Customer. We receive a limited licence to process it only to provide the Service.

7.2. The platform belongs to us: the code, design, structure and any improvement developed during the engagement. Nothing in this agreement transfers any right in them.

7.3. Separation between customers. The system is built so that each customer sees only its own data.

7.4. Aggregated data. The Provider may use aggregated, anonymous usage data, which does not identify the Customer or its end customers, to improve the Service. The Provider does not train artificial intelligence models on Customer content.

7.5. At the end of the engagement the Customer may export its data within 30 days. After that it will be deleted, except what must be kept by law.

8. Availability

8.1. We aim for high availability and do not commit to continuous availability. A binding service level agreement (SLA) will be signed separately and for an additional fee.

8.2. The Service depends on third-party providers. A fault, policy change or discontinuation on their side is not our responsibility and is not a breach.

8.3. Planned maintenance will be carried out at off-peak hours, with advance notice where possible.

8.4. Backups are made on an ongoing basis. The Provider does not commit to recovery objectives (RPO/RTO) unless agreed in writing.

9. Limitation of liability

9.1. The Service is provided as is, without warranty of any kind, express or implied, including fitness for a particular purpose or non-infringement.

9.2. We do not promise that the Service will be free of faults, that results will be accurate, or that any business results will be achieved.

9.3. In no event shall we be liable for loss of profit, loss of income, loss of customers, loss of goodwill, loss of data, or any indirect, consequential, special or punitive damage, even if we were told such damage was possible.

9.4. The Provider's total liability, on any ground, cumulatively, shall not exceed the subscription fees actually paid in the 3 months before the event.

9.5. A claim must be filed within 12 months of the cause arising, after which it lapses.

9.6. This section does not apply to damage caused wilfully or by gross negligence, or to liability that cannot be excluded by law.

10. Indemnity

10.1. The Customer will indemnify the Provider for any claim, demand, damage, expense and legal fees arising from:

  • breach of these terms or of the law by the Customer
  • content its AI agent sent to an end customer
  • sending messages without lawful consent
  • a claim by one of its end customers regarding privacy, spam or misleading conduct
  • use of data collected unlawfully

10.2. We will notify the Customer of the claim and allow it to defend, provided it does not settle without our consent.

11. Confidentiality

11.1. Each party will keep the other's business information confidential and will not use it except for the engagement. This obligation remains in force for 3 years after the engagement ends.

12. Termination

12.1. The Customer may terminate at any time, subject to section 6.3.

12.2. We may suspend or terminate immediately in the event of material breach, unlawful use, prolonged non-payment, or harm to the stability of the system or to other customers.

12.3. On termination access is blocked, and sections 7, 9, 10, 11 and 13 remain in force.

13. Miscellaneous

13.1. Changes to the terms. We will give 30 days' notice. Continued use means acceptance. A material change entitles the Customer to cancel without penalty.

13.2. Force majeure, including war, cyber attack, an infrastructure provider outage, or an order of an authority.

13.3. Entire agreement. This document, together with the Privacy policy, is the entire agreement.

13.4. Assignment. The Customer may not assign its rights without our approval. We may assign as part of a merger or sale of business.

13.5. Partial invalidity does not affect the validity of the rest.

13.6. Law and jurisdiction. The laws of the State of Israel only, with exclusive jurisdiction to the courts of Tel Aviv.
